Terms of Use – Galleries & Image Viewing

1. Scope

These Terms of Use govern access to and viewing of visual content displayed in the online galleries of mariaalexea.com, including photography, paintings, film stills, and related artistic works.

They apply exclusively to gallery browsing and image viewing. They are complementary to and governed by the main Terms and Conditions, which prevail in case of conflict.

2. Permitted Use

Gallery content is made available for personal, private, and non-commercial viewing only.

• Accessing and viewing images through a standard web browser is permitted.
• No licence, ownership right, or usage right is transferred.
• Access to the galleries does not constitute permission to reuse the content.

3. Prohibited Uses

Unless expressly authorised in writing by Maria Alexea or by Transformatio Amoris ASBL acting within the scope of its mandate, the following actions are strictly prohibited:

• Downloading, copying, or extracting images or visual elements
• Screenshots, screen recording, or capture by any technical means
• Re-uploading, reposting, embedding, or redistributing content on other platforms
• Use in publications, presentations, exhibitions, NFTs, datasets, or archives
• Training, fine-tuning, or feeding artificial intelligence systems or machine-learning models
• Creation of derivative works, adaptations, composites, or altered versions
• Any commercial, promotional, or institutional use

4. Intellectual Property & Moral Rights

Copyright and moral rights in all artistic works created by Maria Efthymiou, professionally known as Maria Alexea, remain exclusively vested in her.

Transformatio Amoris ASBL operates and administers mariaalexea.com and is authorised to manage publications, administer licensing requests, protect the works and enforce the related rights on the artist’s behalf.

This authorisation does not transfer ownership of copyright or moral rights to Transformatio Amoris ASBL.

• Removal or misrepresentation of authorship is prohibited.
• Alteration of the works or their context without authorisation is prohibited.
• The artistic, conceptual and narrative integrity of the works must be respected.

Rights in any third-party material remain vested in their respective owners.

5. No Waiver of Rights

The absence of a watermark, technical protection measure or visible copyright notice does not imply consent, permission or waiver of rights.

Unauthorised use may constitute copyright infringement and may give rise to civil liability and, where applicable, criminal liability under the relevant law.

6. Reference to Master Terms

Legal conditions related to purchases, streaming access, downloads, licences, liability, and jurisdiction are governed exclusively by the Terms and Conditions.

7. Governing Law & Jurisdiction

These Terms are governed by Belgian law, without prejudice to any mandatory provisions of applicable law.

Any dispute arising from or relating to these Terms or the use of this website shall be submitted to the competent courts of Mons, Belgium, subject to any mandatory rules of jurisdiction.
