Firebird: From “Hermès Campaign Greece” to “hermes 2014”

A work created in 2008, two Greek court judgments, years of French proceedings — and, in 2026, the reappearance of the same photograph, depicting the creator herself, in a corporate publication without her permission and without her name.

I am the creator and the person depicted in the photograph Firebird – Bird of Fire (2008). It is neither an unknown nor an undocumented work. A variation from the Firebird thematic series was included in the catalogue of the 2008 exhibition Goethe’s Greek Dream at the Goethe-Museum in Düsseldorf. The catalogue circulated internationally, and a copy is preserved in the Goethe-Museum’s own collection.

In 2013, Firebird was presented in New York as part of my Ecology of Dance exhibition at the Consulate General of Greece. The exhibition also featured a limited-edition deluxe lithograph, produced in 2012 in a run of 200 copies, that circulated widely in New York during the exhibition.

At the same time, The National Herald published an illustrated announcement of the exhibition on 16 November 2013, featuring the Firebird photograph.

The National Herald — 16 November 2013, p. 2

During 2012–2013, however, the same photograph began circulating online without my name and under the label “Hermès Campaign Greece.”

I informed Hermès in 2013. The company replied that it would ask Pinterest to remove the relevant posts and later informed me that it had repeated its request.

The two Greek court judgments

Legal proceedings followed in Greece concerning unauthorised professional uses of the photograph.

Judgment 8469/2017 recognised the unauthorised use of the photograph, the omission of my name and the duty of professional users to verify the origin and rights attached to an image. The label “Hermes Campaign, Greece” was not considered sufficient to relieve them of that obligation.

The Athens Court of Appeal subsequently reconsidered the case in Judgment 1019/2019, ruled afresh on the merits and awarded a total of €21,000, plus interest, against the infringers.

The same photograph had therefore already been the subject of two Greek court judgments, with infringement recognised and damages awarded against the infringers.

The case was also covered by Kathimerini:

The French proceedings

In parallel, I had reported similarities between earlier works of mine — including works from the Firebird thematic series — and Hermès advertising campaigns. The dispute was brought before the French courts. Publicis Activ France also intervened in the proceedings as the advertising agency that had designed the disputed campaigns for Hermès.

In 2021, Hermès and Publicis sought to have the writ declared null and void, arguing that the works and alleged infringements had not been identified with sufficient precision. Their objection was rejected. The court found that the works and disputed comparisons had been identified sufficiently for the proceedings to continue.

Légifrance — Decision of 8 April 2021

In 2023, however, the Tribunal judiciaire de Paris held that the claims relating to campaigns before 28 November 2014 were time-barred, because the five-year limitation period had expired by the time the writ was served on 28 November 2019.

Those claims were therefore not examined on the merits.

The 2016 Galop d’Hermès campaign was examined separately and dismissed on evidential grounds.

Légifrance — Judgment of 16 February 2023

Under the same judgment, I was ordered to pay €10,000 to Hermès and €10,000 to Publicis. I appealed, but I did not have the financial means to pay the €20,000. Following applications by the two companies, the appeal was struck off the court list for non-enforcement of the first-instance judgment.

My appeal has not been examined on the merits.

The delay preceding service of the French writ is now the subject of a separate professional-liability claim against my former French lawyer.

In 2026: “hermes 2014”

In June 2026, I found Firebird again, this time not in a random internet post but in Coulisse Journal #2 – Revive, a corporate publication of the Dutch company Coulisse B.V., which operates internationally in window-covering systems and interior products.

The photograph, in which I am depicted, appears immediately after the cover as the dominant opening image, without my name, with the word “REVIVE” placed over the image and with the label “hermes 2014.”

The issue therefore goes beyond a missing photographic credit. It concerns the use, in a corporate publication and under a different identifying label, of an earlier work with a documented public history dating back to 2008, in which I am both the creator and the person depicted.

That label takes on particular significance in light of the previous history of the same photograph. The work had circulated online as “Hermès Campaign Greece”; two Greek court judgments followed, as did years of French proceedings; and more than a decade later it appears in a corporate publication under the label “hermes 2014.”

In this specific corporate and commercial context, there is no mythological or historical element that would explain “Hermes” as a reference to the ancient Greek god Hermes. What is certain is more specific: the same photograph that had previously circulated under the misleading identity “Hermès Campaign Greece” reappears years later without the creator’s name and once again under the label “Hermes.”

I do not yet know where Coulisse obtained the photograph, who added the label “hermes 2014”, who approved this particular use, or how extensive the printed and international distribution of this issue was.

Coulisse operates internationally and maintains a presence at major industry events, including R+T Stuttgart, as well as in other markets. The relevant channels have therefore been asked to clarify how widely this particular issue was circulated, and through which countries, trade fairs and distribution networks.

On 8 July 2026, I sent a formal extrajudicial notice to Coulisse B.V. On 31 July 2026, I filed a criminal complaint and report with the Public Prosecutor’s Office of the Athens Court of First Instance, requesting an investigation, among other matters, into the source of the photograph, the label “hermes 2014”, the individuals who selected or approved its use, and the extent of the publication’s printed and digital circulation.

The chronology is specific: a work created in 2008; the Goethe-Museum Düsseldorf catalogue; a limited edition of 200 lithographs circulated widely in New York; The National Herald; two Greek court judgments; years of French proceedings; and two French decisions.

And in 2026, the same photograph, in which I am depicted, appears again without the creator’s name, this time under the label “hermes 2014.”

No special characterisation is required. The facts speak for themselves.

The only remaining question is how many judicial proceedings and judgments an independent creator must endure before their name, their image and the identity of their own work are effectively protected in practice.

The National Herald — 16 Νοεμβρίου 2013, σελ. 2

Το 2026: «hermes 2014»
